By downloading, accessing, or using Whaphotos, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. You must be at least 13 years old to use Whaphotos. By using the service you confirm that you meet this age requirement.

2. Description of Service

Whaphotos is a social photo-sharing application that provides daily photo challenges. Users can take photos based on daily prompts, share them with friends, and engage with others' content through reactions and comments.

3. User Accounts

You must create an account to use our service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at whaphotoinfo@gmail.com.

4. Content Guidelines

Users must not post content that:

5. Photo Challenges

Daily challenges are provided for entertainment and creativity. Users may only submit one photo per challenge period. We reserve the right to modify, suspend, or discontinue challenges at any time without notice or liability.

6. User Content & License

You retain ownership of photos you upload. By posting content, you grant Whaphotos a non-exclusive, royalty-free, worldwide license to display, store, reproduce, and distribute your content within the platform for the purpose of operating the service. This license ends when you delete the content or your account. You may delete your content at any time through the app.

7. Copyright & DMCA

We respect intellectual property rights. If you believe content on Whaphotos infringes your copyright, please send a written notice to whaphotoinfo@gmail.com including: a description of the copyrighted work, the location of the infringing content, your contact information, and a statement that you have a good faith belief the use is unauthorized. We will respond to valid DMCA notices promptly.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

9. Termination

We may suspend or terminate your account at any time for violations of these terms or for any other reason at our sole discretion, with or without notice. You may delete your account at any time through the app settings. Upon termination, your license to use the service ceases immediately.

10. Disclaimer of Warranties

Whaphotos is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Whaphotos and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the service, even if advised of the possibility of such damages. Our total liability to you for any claims arising from these terms or your use of the service shall not exceed the amount you paid us in the twelve months preceding the claim (or $10 USD if you have paid nothing).

12. Indemnification

You agree to indemnify, defend, and hold harmless Whaphotos and its operators from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these terms.

13. Governing Law & Disputes

These terms are governed by the laws of Bulgaria. Any disputes arising from these terms or your use of the service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Bulgaria. You waive any right to participate in a class-action lawsuit or class-wide arbitration against Whaphotos.

14. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via the app or email. Continued use of the service after changes constitutes acceptance of the updated terms.
